Privacy Policy of the Malaysian Society of Clinical Hypnosis (MSCH)

The Malaysian Society of Clinical Hypnosis (MSCH) is committed to protecting your privacy and ensuring that your personal data is handled responsibly and in compliance with the Malaysian Personal Data Protection Act 2010 ("PDPA"). This policy outlines how MSCH collects, uses, maintains, and discloses information collected from our members, affiliates, website visitors, and other stakeholders.

    • Identity Data: Name, date of birth, gender, nationality, and identification card/passport number.

    • Contact Data: Membership number, postal address, email address, and telephone number(s).

    • Professional Data: Professional qualifications, certifications, clinical experience, indemnity insurance details, and employment history.

    • Financial Data: Bank account details and payment information related to membership fees or event registrations.

    • Technical Data: IP addresses, browser type, operating system, and data collected via cookies for website functionality and analytics.

  • Sensitive Personal Data:

    • We recognise that we may process Sensitive Personal Data (e.g., information concerning your physical or mental health/condition, or professional conduct records related to ethical complaints). This data is processed only for the specific purposes outlined below and will always require your explicit consent.

2. Purpose of Processing Your Data (Lawful and Fair Use)

 

MSCH processes your personal data only for lawful purposes directly related to our functions as a professional society and in the context of commercial transactions, including:

  • Membership & Administration: To process applications, renewals, fee payments, and maintain the official register of MSCH members.

  • Ethical & Regulatory Compliance: To verify professional credentials, enforce the MSCH Code of Ethics, and manage and investigate complaints or disciplinary matters.

  • Communication: To send essential updates, newsletters, invoices, event invitations, and other notices relevant to your membership and the profession.

  • Education & CPD: To organise, administer, and track your participation in courses, seminars, and Continuing Professional Development (CPD) activities.

  • Public Listing: To publish your professional details (with your consent) in our public 'Find a Practitioner' directory.

  • Legal Obligation: To comply with any legal or regulatory requirements in Malaysia.

3. Notice and Choice Principle (Consent)

 

By providing your personal data to MSCH, you are deemed to have consented to its processing in accordance with this Privacy Policy.

  • Right of Choice: We will provide you with clear options to opt-out of processing your data for certain uses (e.g., direct marketing or inclusion in the public directory).

  • Withdrawal of Consent: You have the right to withdraw your consent for the processing of your personal data, in full or in part, by notifying the MSCH Data Protection Officer in writing. MSCH will cease processing your data upon receiving the withdrawal request, unless such processing is required or permitted by law. Please note that withdrawing consent may affect your ability to maintain membership or access certain MSCH services.

MSCH will not disclose your personal data to any external party without your express consent, except in the following limited and necessary circumstances (The Disclosure Principle):

  • Legal Requirements: Where disclosure is required by law, court order, or a statutory/government authority.

  • Affiliated Bodies: To other professional or affiliated bodies (e.g., the British Society of Clinical Hypnosis - BSCH) for the purposes of cross-validation of qualifications, strictly as required for your membership or services.

  • Public Directory: Only the information you have explicitly consented to be made public will be disclosed via the MSCH directory.

  • Security Principle: MSCH implements reasonable and practical measures to protect your personal data from loss, misuse, modification, unauthorised or accidental access or disclosure, alteration, or destruction.
