Complaints Procedure
Complaints and Disciplinary Procedures
The Malaysian Society of Clinical Hypnosis (MSCH) is committed to upholding high standards in clinical hypnotherapy practice and ensuring public protection concerning our members and accredited training courses.
If you have concerns or wish to make a complaint about a MSCH member, accredited training provider, volunteer, or staff member, please fill in the complaint form. By submitting your complaint, you confirm that the information provided is accurate to the best of your knowledge. You also authorise the MSCH Complaints Department to share relevant information with appropriate staff or committee members to address your concern.
Note: Some details may be shared with the MSCH member involved to allow them to respond to the complaint.
Complaints Procedure
(a) The Executive Committee (EC) shall have the power to appoint a special Complaints Committee of at least five senior Members of the MSCH who are not on the EC. This committee will investigate all complaints. The Complaints Committee shall report its findings and recommendations to the EC at its next available meeting.
(b) The EC may, at its discretion, choose to delegate the responsibility of investigation to an external professional body.
(c) No Member of the EC, Disciplinary Committee (DC), or Complaints Committee shall be involved in any investigation concerning themselves.
(d) Members of the public with a complaint against any MSCH Member must submit the complaint in writing to the Secretary of the MSCH. The Secretary shall then lodge the complaint with the Complaints Committee and keep the complainant informed of each stage of the process with regular written reports.
(e) Should a complaint be upheld by the Complaints Committee, the matter will be placed before the EC, which has the power to:
Censure the member.
Impose a fixed-period Suspension on the member.
Expel the member.
Disqualification and Disciplinary Procedure
(a) Should a member be found guilty of a breach of the MSCH Code of Ethics, the EC may, by resolution, terminate their membership. The EC may delegate its powers to a Disciplinary Committee (DC) of at least five MSCH members, of whom at least one shall be an EC member. A quorum for the DC shall be three.
(b) A member whose conduct is in question will receive a notice of intent to propose a resolution for their removal at least fifteen days before the meeting. The member is entitled to attend and be heard at this meeting and may appeal the decision to an Extraordinary General Meeting (EGM). However, if the appeal is unsuccessful, the appellant shall bear all costs of the EGM and associated notices. The EC or DC may require a deposit to cover the estimated costs before the EGM notices are posted.
(d) Failure to comply with the relevant rule of the MSCH Code of Ethics regarding proscribed organisations will result in a member's immediate expulsion. Members have the right to appeal to the EC in writing within 15 days of receiving notification of the judgment. The decision of the EC on this matter is final, and there is no right of appeal to an EGM.
(e) Organisations deemed to be in breach of the Code of Ethics will be proscribed by a resolution of the EC. Proscribed Organisations have the right to request a change in their status by a written request to the Organising Secretary. The organisation has the right to attend and be heard at the EC meeting where their request is considered and may appeal the decision to an EGM. If the appeal is lost, the organisation shall bear all costs of the EGM and notices, with a deposit required beforehand.
